These Terms of Use ("Terms") govern your use of tekdek.app and Tekdek Connect at tekdek.app/connect (together, the "Sites"), operated by TekDek Software, Inc. ("Tekdek," "we," "us"). By using the Sites you agree to these Terms. A Tekdek software subscription, account, or the Tekdek Onsite app is governed by the Tekdek software Terms of Service.
1. Using the Sites
You may browse the Sites and submit accurate, lawful inquiries for their intended purpose. You agree not to submit false identities, companies, or projects; use the forms for spam or any unlawful purpose; interfere with or disrupt the Sites; attempt to gain unauthorized access to them; or scrape them in a way that burdens the service. You are responsible for the information you choose to submit.
2. Product information, examples, and pricing
The product previews, sample quotes, prices, margins, proposals, material orders, calculators, and comparisons shown on the Sites are illustrative. They are not live customer data, a binding offer, or a promise of a particular result. Results from the ROI calculator are estimates based on the numbers you enter.
Features, availability, and pricing can change. The price and terms that apply to a subscription are the ones presented when you sign up and in the Tekdek software Terms of Service.
Comparisons with other products reflect our understanding of publicly available information at the time of writing. Other companies' names and trademarks belong to their owners, and their products may have changed since.
3. Articles and other content
Articles, guides, and blog posts are provided for general information. They are not legal, insurance, financial, or professional advice. Check the cited sources and your own circumstances before relying on them.
4. Tekdek Connect
Tekdek Connect lets homeowners and property managers tell us about an exterior project, and lets contractors apply to join our network. Submitting a project request or a contractor application does not guarantee a match, an introduction, a listing, a number of leads, a response time, or a job. We review requests and applications and decide whether to make an introduction.
Contractors are independent businesses, not employees or agents of Tekdek. Customers and contractors are each responsible for their own due diligence, including licensing, insurance, references, scope, pricing, permits, written agreements, the work itself, and payment. Tekdek is not a party to any contract between a customer and a contractor and is not responsible for the work performed or for payment.
5. Intellectual property
Tekdek owns or licenses the text, design, graphics, software, and other content on the Sites, and the Tekdek name and logo. You may view the content to evaluate our products and services. You may not copy, republish, or reuse it in a way that suggests we endorse you without our written consent.
6. Third-party links
The Sites link to services we do not control, such as social networks and the sources cited in our articles. Those links are provided for convenience. We are not responsible for the content or practices of third-party sites.
7. Disclaimer of warranties
THE SITES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. We work to keep the Sites accurate and available, but we do not warrant that they will be error-free or uninterrupted.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TEKDEK SOFTWARE, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITES OR ANY INTRODUCTION MADE THROUGH TEKDEK CONNECT. Nothing in these Terms limits rights that cannot legally be limited.
9. Governing law
These Terms are governed by the laws of the United States of America, without regard to conflict-of-law principles.
10. Changes to these Terms
We may update these Terms from time to time. The effective date at the top shows the current version. Continuing to use the Sites after a change takes effect means you accept the revised Terms.
